Removal of 12 Day Rule
From 01 January 2006, all Employers will be required by law to pay contributions for all their Employees, no matter the number of days that the Employees have worked.
Previously, the FNPF Act covered only Employees who worked for more than 12 days in a month. It was often called the 12-day rule.
Employers are reminded that they 12-day rule is no longer valid from 01 January 2006 and that they must pay contributions for all employees even if that employee worked only for one in a month.
Please note that this does NOT refer to changes in the definition of Employees and Employers that will come into effect from 01 July 2006. This only refers to the removal of the 12-day rule.
Changes Relating to Expatriate Members
It is no longer compulsory for a person employed in the Fiji islands who is NOT a Fiji Citizen to be a member of FNPF.
A person employed in Fiji who is NOT a Fiji Citizen together with his of her Employer may, by notice in writing given to the General Manager, elect that the Employee become a member of the Fund, provided such a notice is given within three months AFTER commencement of his or her employment in Fiji.
Voluntary Membership
From 22 August 2005, employees over the age of 65 can continue to contribute but on a voluntary basis. They no longer have to fully withdraw from the Fund.
